中国刑事政策三十年“路线图”

刑事政策是指导一国犯罪防治工作的总体策略，其科学与否对该国犯罪防治效果及刑事法治的发展有重要影响。时值我国1979年刑法施行30周年之际，探讨30年来中国刑事政策的历程有助于发掘刑事政策演变背后的更深层次的问题。重新梳理相关刑事政策间的关系，并分析其演变后的社会因素，是把握今后刑事政策发展方向的必然要求。

关于“普鲁士式道路”的典型性问题再认识

马克思主义经典作家一般把“英国式道路”看作是现代农业资本主义发展的典型形态，而把“普鲁士式道路”看作只是一个例外。这种改良的道路是在最大限度地保留农奴制残余的基础上，把封建领主制经济缓慢地转化为带有资本主义性质的容克地主经济，不仅使农民长期遭受资本主义和封建制度的双重剥削，而且把德意志民族带入军国主义的泥潭而不能自拔。二战结束后，东德通过实行民主土地改革和农业社会主义改造，彻底铲除了容克地主阶级的生存土壤，“普鲁士式的道路”走向历史终结。德国实现统一后，德东地区进行的土地私有化和市场化改革并没有像西德那样完全实行小规模的家庭农场经营，而是继续保持大型国营农场和农业合作社在经营规模、机械化水平、农业劳动生产率等方面的优势。这对于我国目前正在进行的小农经济改造和现代农业发展具有重要的借鉴意义。     

Simulation-based reconstruction of traffic incidents from moving vehicle mono-camera

Video recordings from digital cameras implemented in road vehicles present a valuable source of data concerning various dangerous traffic situations, i.e., road accidents or near-miss incidents. This data is readily available and numerous methods for forensic reconstruction of traffic situations from vehicle video were presented in the past. New alternative method for reconstruction of traffic situations from vehicle video is presented in this article. The method is based on the fusion of kinetic vehicle trajectory simulation within 3D laser scanner point cloud, projective geometry, and processing of video footage from moving vehicle camera. The method offers accurate reconstruction of general vehicle motion within relevant time domain whereby in-depth technical information about traffic incident can be quantitatively extracted from video footage. The result is physics-based 3D projection of simulated vehicle motion on the motion of real vehicle recorded by moving monocular camera. The method was validated within performed experimental test runs with respect to vehicle speed, distance travelled, acceleration/deceleration and directional quantities (yaw rate, yaw angle). The method was further applied in the reconstruction of real-world traffic events.

2009年2月公布的《中华人民共和国保险法》在很多方面进行了重大的修改,势必对中国海上保险合同法律制度产生重要影响。一方面是对海上保险合同法律的补充,另一方面同《中华人民共和国海商法》在海上保险合同不少制度和规则上出现了程度不同的差异。而这些也为后者未来的修改提供了丰富的素材和良好的借鉴蓝本。     

New Measures for China's Westward March

正In November 2013,the Third Plenary Session of the 18th CPC Central Committee approved the Decision on Major Issues Concerning Comprehensively Deepening Reforms.The decision stated that efforts should be made to accelerate infrastructural connections among neighboring countries and regions and to promote construction of the Silk Road economic belt and Maritime Silk Road,forming an all-round opening-up pattern.     

The Maritime Channel in Southeast Asia and China’s Strategic Pivots

With its transition from land power to sea power and the rapid expansion of its national interests, the security of maritime channels has become an important agenda for China. China has shifted its focus from the dilemma of Malacca Strait to the construction of a sea-lane network in its bid to protect its maritime rights and interests. To build its sea power as a strong nation, China should follow its “21st Century Maritime Silk Road” strategy and establish its strategic pivots at harbors at Sumatra Island and Kalimantan Island in Indonesia so as to improve its ability to ensure its navigational safety.     

Theory of Land-Ocean Peaceful Cooperation: a Geopolitical Study of the Sustainable Security of One Belt One Road

The joint establishment of One Belt One Road is a practice of international cooperation initiated by China and actively participated by other countries. One of the important issues is how to ensure sustainable common security, and what kind of geopolitical theory should be employed for guidance. Traditional geopolitical theories, such as sea power theory, land power theory and Rimland theory, mainly serve for the fi ght for geopolitical hegemony or military strategy. They are in sharp contrast with the goal of One Belt One Road, which is of mutual interest and a win-win situation. However, One Belt One Road is still regarded by some countries from the traditional geopolitical perspective. To equip One Belt One Road with new geopolitical concepts, the author hereby proposes the theory of land-ocean peaceful cooperation, which is a non-alliance network community of common interests, security and destiny. This community would be established for mutual benefi ts, between ocean countries and land countries, among ocean countries and among land countries. It could help policy communication among participant countries of One Belt One Road, and the establishment of an open net-like system of peaceful operation and common development. The theory of land-ocean peaceful cooperation of sustainable security, together with the practice of international cooperation of One Belt One Road, will undoubtedly break through the vicious cycle of the Eurasian geographical fi ght and confrontation between sea powers and land powers illustrated by the traditional geopolitics.     

《道路交通安全法》中"交通事故"定义评析

关于道路交通事故的定义,《道路交通安全法》在《道路交通事故处理办法》的基础上作了修改.从法学和逻辑学的角度上分析,修改后的定义仍然存在着定义不准、概念不清等问题,影响到该法的准确实施.科学定义道路交通事故概念,首先要明确《道路交通安全法》的立法目的和法律特征,其次要明确道路交通事故概念构成的内在要件和外在要件,第三要遵从语词规则.     

共建21世纪海上丝绸之路——走出东亚格局中的二元困境

传统东亚格局具有明显的一元化特点,无论是经济贸易还是政治安全都高度依赖美国。伴随中国经济的快速崛起,东亚经济体对美国的经济贸易依赖逐步被中国所取代,从而形成当前东亚地区格局中的二元困境,即政治安全依赖美国,而经济贸易依赖中国。同时20世纪90年代末金融危机后逐步形成的东亚传统的合作模式也遭遇多层面挑战。中国新一届政府提出的建设21世纪海上丝绸之路的战略构想,基础扎实、背景厚重、举措有力、开放度高、统领力强,在区域合作架构上实现了一系列重大突破,也为走出东亚格局中的二元困境开启了可行路径。中国是构建21世纪海上丝绸之路的发起者,东盟是21世纪海上丝绸之路的重点地区,通过共建21世纪海上丝绸之路,中国与东盟关系将发展到全新阶段,提升至更高水平。
